Re:       Senate Bill 585, Mandatory Meetings

            Date:    April 22, 2010

The Alliance of Wisconsin Retailers generally supports any legislation that does not increase the costs of doing business in the state or unreasonably increase administrative       burdens on employers in dealing with employment and workplace issues. Unfortunately, SB 585 is a measure that would be very problematic for employers because it would present a tremendous burden on their ability to effectively communicate with their employees; therefore we oppose this legislation.

Congress created the National Labor Relations act (NLRA) to encourage a healthy relationship between private-sector workers and their employers and to “insure both the employers and labor organization full freedom to express their views to employees on labor matters.” National Labor Relations Act, Section 8(c).

The NLRA is administered by the National Labor Relations Board (NLRB) a federal agency which exercises exclusive authority over the law governing relations between unions and private sector employers. Accordingly, states are precluded from governing any area of law covered by the NLRA.  Only the State of Oregon has passed similar legislation to SB 585 and it is currently being litigated at a cost to the state.

On the last day of session, the legislature should be focusing on job creation.  This bill    only makes the business climate in Wisconsin more hostile to job growth and business expansion.  Please oppose SB 585.

The Alliance of Wisconsin Retailers LLC is comprised of leading national and    Wisconsin-based retailers who employ over 50,000 tax-paying residents of this state.
