Rep. Neylon Votes to End Governor Evers’ Unlawful State of Emergency Extensions

Madison— On Thursday, Rep. Adam Neylon (R-Waukesha) joined his Assembly Colleagues in voting to terminate Governor Evers’ State of Emergency and statewide mask mandate.

“Today I voted in favor of Senate Joint Resolution 3, to put a stop to Gov. Evers’ continuous executive overreach. The fact of the matter is a Wisconsin Governor does not have the legal authority to extend an emergency order beyond 60 days unless the legislature votes to extend it. Wisconsin Statute 323.10 reads, "[a] state of emergency shall not exceed 60 days, unless the state of emergency is extended by joint resolution of the legislature."

“My vote today is not about masks. I support the use of masks in reasonable circumstances and I encourage my constituents to use them. This resolution does not prevent any county, local community, school district, business or church from requiring masks, nor does it prevent any individual from wearing them.

“Moving forward Gov. Evers must follow the clearly defined process of administrative rule-making. I have reached out to both the Department of Health Services and Governor’s office to find common ground on issues facing Wisconsin but they have yet to take me up on my offer. There are checks and balances in government, and today my colleagues and I are standing for the rule of law.”
