Wisconsin's Fair Dealership Law Restricts Municipal Control on Contracts
This week a bill I authored (SB 105), the Fair Dealership Law, passed the Senate and is awaiting a hearing in the Assembly.
While the Wisconsin Fair Dealership Law generally regulates transactions between suppliers and dealers, a recent court decision has applied this statute to governmental contracts with private sector service providers. Under the court's decision, Wisconsin's villages and cities could potentially be forced to retain contractors even when they have failed to meet the needs, costs or quality standards of the community. Without the opportunity to discontinue agreements with poor service providers, communities can become locked into a contractual relationship that produces unacceptable or costly results for the residents. My bill will exempt government entities from this law.
Ensuring our communities and their leaders have control over their decision making has been a priority for me. This is one more effort to make good on that commitment.
JFC Approves I-41 Project
On Thursday, the Joint Finance Committee approved the Interstate-41 project. Specifically, the project targets a stretch in Brown and Outagamie Counties that extends approx. 23 mile stretch between Hwy 96 to County High F. The motion requires that the DOT construct an interchange in De Pere at Southbridge Road.
The motion provides $4 million in the first year of the budget and $2 million in the second year of the budget to help pay for needed environmental review studies and interchange report.
