Lazich Responds to Supreme Court Ruling on Act 10

The State Supreme Court overruled Dane County Circuit Court Judge Maryann Sumi in a ruling released Tuesday afternoon.

The Supreme Court ruling states "… all orders and judgments of the dane County Circuit Court in Case No. 2011CV1244 are vacated and declared to be void ab initio." Void ab initio means "to be treated as invalid from the outset."

Furthermore, "This court has granted the petition for an original action because one of the courts that we are charged with supervising has usurped the legislative power which the Wisconsin Constitution grants exclusively to the legislature."
Wisconsin Act 10 is now law.

State Senator Mary Lazich (R-New Berlin) issued the following statement in response to the Supreme Court ruling.

"I am pleased to see that, finally, three months after Republicans took legislative action, the Wisconsin Supreme Court affirmed those actions," Lazich said.

"The actions of activist judges should not interfere with the legislature. Judge Sumi overstepped her responsibilities with her activist ruling. The Supreme Court ruling is a win for voters electing members to the three branches of government. The ruling is a reaffirmation of separation of powers in Wisconsin."
