Supreme Court Injunction on Issue Ad Regulations
The Wisconsin Supreme Court last week on a 4-3 ruling issued an injunction on the Government Accountability Board’s (GAB) new issue ad disclosure rules, which came on the heels of GAB’s tentative lawsuit settlement that had much of the same effect as the injunction. On July 31, 2010, GAB finalized new rules that would have made individuals and groups transmitting communications about candidates’ personal qualities, positions, or public records to file reports under campaign finance requirements, even if the communication did not expressly encourage others to vote for or against a candidate. Current campaign finance law, which remains in effect despite the Supreme Court’s injunction, subjects individuals and groups to campaign finance laws if they sponsor communications that specifically advocate voting for or against candidates.
