Truth in Advertising – Senate Bill 837

  • Prohibit companies from advertising their service as “broadband” unless it is capable of providing minimum download speeds of 25Mbps and 3 Mbps while uploading, or meets the federal definition of broadband, whichever is higher.
  • Prohibit fine print on advertisements from diminishing the quality of the broadband service provided. For example, this provision prevents companies from advertising speeds up to 25 Mbps and then only delivering 5 Mbps.
  • Adopt a consumer label, similar to packaged foods, so consumers can easily compare broadband services.
  • Enhance penalties for companies that violate broadband service consumer protections.

 

Dig-Once and Mandatory Connection – Senate Bill 835

  • Allows a city, village, town, county or the Wisconsin Department of Transportation to require installation of empty conduit lines for future fiber optics expansion.
  • Require companies that install fiber optics in ROW to provide service to consumers along the way.

 

Municipal-Owned Broadband Networks & Staffing Grants – Senate Bill 836

  • Eliminate the requirement for municipalities to jointly submit grant applications with private internet service providers.
  • Allow municipalities to use broadband expansion grant money for project planning purposes.
  • Eliminate feasibility study requirement for municipalities to create and expand municipal-owned broadband networks. (66.042 (2) (c))
  • Allow municipalities to apply for grant funds to hire municipal broadband directors. Funds would be used for up to 50% of the cost to hire one staff.

 

Broadband Expansion Grant Program Integrity – Senate Bill 838

  • Requires grant recipients to provide broadband speeds that are at least 25 Mbps (megabits per second) while downloading and 3 Mbps while uploading, or the speed set by FCC if higher than 25/3.
  • Requires grant recipients to report to the Public Service Commission (PSC) how many broadband connections were established with the grant funds and the average speeds provided to customers after completion of the project.
  • Allows PSC to recoup funds from grant recipients who failed to provide the required speeds or connections listed in their grant applications and reuse funding for other grants.
  • Prohibits companies from receiving broadband expansion grant funds if they failed to pay back funds for not complying with program requirements.
  • Allows the Legislative Audit Bureau to conduct a performance evaluation of the broadband expansion grant program.
