Wisconsin Supreme Court Strikes Down "Safer at Home" Order

Wisconsin-Supreme-Court-e1519846717951.jpg

Hello,

On Wednesday night, the Wisconsin Supreme Court ruled that DHS Secretary-Designee Andrea Palm's extended "Stay at Home Order" was "unlawful" and "unenforceable". With this court ruling, the extended order has been nullified.

Read the full opinion here.

Wisconsin now joins multiple states that don't have extensive ‘stay at home orders’ but can continue to follow good practices of social distancing, hand washing, hand sanitizer usage and telecommuting. This ruling does not promote people to act in a way that they believe endangers their health.

I and my Republican colleagues in the legislature believe business owners can safely reopen using the guidelines provided by the Wisconsin Economic Development Corporation. We urge our fellow small business owners to utilize the suggestions as a safe and effective way to open up our state.

Manitowoc and Calumet Counties Rescind "Safer at Home" Orders

Just this afternoon on May 15th, Manitowoc County and Calumet County have rescinded their "Safer at Home" orders, initially put in place on May 14th.

Even though the orders have been rescinded, residents are still encouraged to practice safety guidelines laid out by the CDC, which can be found here: https://www.cdc.gov/coronavirus/2019-ncov/prevent-getting-sick/prevention.html.

Businesses that reopen are highly encouraged to follow safety guidelines setup by the Wisconsin Economic Development Corporation. These guidelines can be found at https://wedc.org/reopen-guidelines/.

Manitowoc County Executive Bob Ziegelbauer released the following statement following the rescinded order:

“One of the reasons we extended the order in Manitowoc County was to be consistent with Brown County, who is dealing with a much more significant outbreak. We didn’t want to draw the virus into Manitowoc County by leaving our bars, restaurants, and other locations open to attract Brown County residents. We want to remain consistent and that’s why we’re following Brown County’s lead in rescinding our order too."
